2009 COLORADO LIMITED LETTER OF ADHERENCE FOR COMMERCIALS

(AFTRA Denver Regional Contract for Television & Radio Commercials)

The following is intended as a summary of frequently requested rates only and does not include Group Singers/Dancers or Hand Models. For a copy of the current Colorado Limited Letter of Adherence for Commercials or a complete listing of rates for commercials produced under the terms of this Regional Contract, please call the AFTRA Denver office at 720-932-8228.

TELEVISION COMMERCIALS:

A. Geographic Scope and Jurisdiction:
Applies to commercials which are:

• 1. Produced in any or all of the following states: Colorado, Kansas (except Kansas City), New Mexico, Utah and Wyoming.
• 2. Broadcast from any of the following states: Colorado, Kansas (except Kansas City), Nebraska (except Omaha), New Mexico, Utah and Wyoming.

B. Broadcast from Denver or Three Cities or Less within the Region

ON CAMERA: $506.99
OFF CAMERA: 378.53
BACKGROUND: 184.86 (applies to first five background performers engaged)
TAGS: 133.95 On Camera $100.73 Off Camera

C. Broadcast from Three Cities or Less within the Region, excluding Denver

ON CAMERA: $412.90
OFF CAMERA: 291.12
BACKGROUND: 184.86 (applies to first five background performers engaged)

When a performer is called for the sole purpose of making tags, he/she shall be paid a session fee, and the above indicated rate for each tag made beyond one; provided the performer is paid use fees for each separate commercial to which the tag is attached, use fees for tags shall be payable on the basis of one commercial.

D. Short-Term Buy Retail Commercials*
Six (6) Week Consecutive Use
ON CAMERA: $394.07

Four (4) Week Consecutive Use

E. One-Year Prepaid Use
Producer and/or Advertising Agency may acquire the right to use the commercial for a period of one year from the date of recording, upon prepayment of a use free equal to two (2) times the first use cycle payment in all categories. Such one year prepaid use must be purchased in advance of the first airing of the commercial and no later than 12 working days after the first session date.

F. Twenty-One Month Prepaid Use
Producer and/or Advertising Agency may acquire the right to use the commercial for a period of twenty-one months from the date of recording, upon prepayment of a use free equal to four (4) times the first use cycle payment in all categories. Such maximum period of prepaid use must be purchased in advance of the first airing of the commercial and no later than 12 working days after the first session date.

G. Non-Air Commercials
ON CAMERA: $343.15
OFF CAMERA: 201.47

H. Broadcast Commercials on Local Cable
ON CAMERA: $58.67/per cycle
OFF CAMERA: 39.76/per cycle

Health & Retirement Contribution: 15.5%

RADIO COMMERCIALS:

A. Geographic Scope and Jurisdiction:
Applies to commercials which are:

• 3. Produced in any or all of the following states: Colorado, Kansas (except Kansas City), New Mexico, Utah and Wyoming.
• 4. Broadcast from any of the following states: Colorado, Kansas (except Kansas City), Nebraska (except Omaha), New Mexico, Utah and Wyoming.

E. One-Year Prepaid Use
Producer and/or Advertising Agency may acquire the right to use the commercial for a period of one (1) year from the date of recording, upon prepayment of a use free equal to two (2) times the first use cycle payment in all categories. Such one year prepaid use must be purchased in advance of the first airing of the commercial and no later than 12 working days after the first session date.

F. Subsequent Prepaid Use
A subsequent and consecutive nine (9) months prepaid guarantee shall be available upon prepayment of a use fee equal to one and one half (1.5) times the first use cycle and Producer/Advertising Agency must obtain the written permission of the performer within the last thirty (30) days of the previously purchased cycle. It is agreed that the first year cycle combined with a consecutive 9 month use cycle equals the twenty-one (21) month maximum period of use.

G. Non-Air Commercials A
