Title: 2009 - Worker's Compensation: Recent Decisions Likely to Increase Benefits and Employer Costs

Description: October 16, 2009 - California's workers' compensation system provides benefits to injured workers. In 2004, changes were made to measure permanent disability (PD) more consistently, reducing benefits for many. Workers argued this was unfair. In 2009, the Workers' Compensation Appeals Board (WCAB) allowed PD measurements to be challenged based on specific cases. This could lead to more changes, lawsuits, and costs, but also higher benefits for workers. The report recommends that the Legislature either let courts handle these disputes or change the law to clarify when PD measurements can be challenged or adjust PD compensation to ensure more uniformity.

The suggested financing plan involves increasing the vehicle license fee rate to 1 percent, generating $1.1 billion in revenue, and redirecting $359 million of existing VLF revenues, ultimately serving as an ongoing budget solution.
