In 2004, changes were made to measure permanent disability (PD) more consistently, reducing benefits for many. Workers argued this was unfair. In 2009, the Workers' Compensation Appeals Board (WCAB) allowed PD measurements to be challenged based on specific cases. This could lead to more changes, lawsuits, and costs, but also higher benefits for workers. The report recommends that the Legislature either let courts handle these disputes or change the law to clarify when PD measurements can be challenged or adjust PD compensation to ensure more uniformity.
